Hi, all, regrettably, I've recently had to delete some images from challenges and other areas of the site due to lack of compliance with Rule #8 of our posting guidelines, which states that artwork (including characters, from Disney, Hasbro, etc.) cannot be copied and posted here without permission from the creatorhttp://cookieconnection.juliau...READ-BEFORE-YOU-POST

In response to those deletions, some members have asked me why so many licensed character cookies exist on the site, presumably without having the necessary permissions.

Here is my response. Please be sure to read it carefully:

Yes, as noted in our site guidelines, we frown upon people copying character cookies without permission, and do not want copied character images on the site if permissions were not obtained. Yes, I am aware that many others don't follow the rules and post character cookies without permission. I point out as many of these errors as possible to those making them, but I am one person and simply don't have the time to keep up with the many errors of this sort each week.

I expect people to read our rules (which they receive on sign-up and which are posted in many areas on the site) and to act on the honor system and follow rules without reminders, but it is practically impossible for me to enforce this rule across the board. However, when images of this sort get into visible challenges or other areas of the site (or when I or other contributors/members happen to notice or report them), we simply have to enforce the rule, as it is not fair to others who have followed the rules.

Read and understood, the rule is pretty clear.

So, I understand it's not possible to post ANY character cookie (including Disney) if there is not permission for it. Even if the author of the cookies has not profit with it. Is this correct?

Certainly, when I first started posting, it was because I saw so much character cookies posted everwhere and so lovely, so nice and perfect that I decided to do that type of cookies myself, really inspired in this page.

I took  courage and posted them anyway as everybody does. Now I was eliminated from a challenge and that was really frustrating.

After this advice: I have erased all of my character cookies from the page, a video and my first 2 tutorials I was so happy of! 

Really  I got very frustrated about being taken out from the challenge and later on, was surprised to see character cookies displayed in:

- previous challenges 

- featured cookies 

- tons of character cookies posted to the page

I sincerely felt this was unfair.  I understand they are rules we all agreed with, but  this rule isn´t exactly running in the site and we invested precious time in these cookies and creations we were so excited about. At least, although in the end, this was sad and frustrating, I have made such a wonderful path together with my nearby and far distance in kms Cookie-friend.

After this has happened, I recommend users to do the same cleanup as there are tons of character cookies displayed and this rule if needed, runs for everyone.

Just thinking, now i will do my own drawings, but if someone makes the copyright of my own drawing: I´m in the same story and this is endless

I can appreciate your frustration - I feel it too, because I have to remind people over and over about this rule. It's frankly exhausting and not how I like to spend my time. The rule has been posted from the very beginning of this site, and, as this is a community-based site (not one I police 24-7), it is incumbent upon members to act on the honor system and follow the rules. When they don't, everyone is cheated - you if your work gets deleted, the creator of the work who has been copied without permission, and me when I spend the time reminding and deleting.

Please also note that this is not an arbitrary rule of the site; it is US copyright law, which I am trying to inform members of, so they do not get into legal or other trouble by copying inappropriately.

And, yes, if people read this and know they have posted copied images here without permission, I think they should remove them.

This is correct. The site rules say do not post ANY copies of ANY artwork (characters or any other source inspiration of any form) that is not yours or known to be in the public domain without seeking permission first and then properly attributing. (This is all explained in the link I posted above.)

The issue here is that this rule is very tough for me to enforce, because people do not follow it each day, I cannot always tell if an image was copied (some people copy more obscure artwork than others), and I do not know if they received permission to post it unless they say or I ask. So some apparent inequities have occurred, because I cannot monitor all cookies posted to this site. All I can say is I am trying to do my best, and I hope that people will help me out by trying to do the same. Thanks!

The top 10 is determined by an automatic site algorithm determined by member views. Only if I were to delete every single character cookie on this site would they not come up in the top 10 at some point or another, and randomly deleting all such cookies would not be fair to those who possibly did get permission to post character cookies, right??

Please understand that it is not feasible for me to police every photo on this site for MANY reasons - there are not enough hours in the day, I cannot afford to hire someone to do it, and, even if I could, I have no way of knowing if someone is posting a character cookie legitimately. Perhaps they indeed got permission - the only way for me to know is to ask every single person who ever posted a character cookie to this site if they did, and I am not planning to do this.

I think we all have to agree that the enforcing of this rule is going to be imperfect at best, and that the only way it could be 100-percent enforceable is if everyone follows the rule to start. But we live in an imperfect world, and this is the best I can do! 

Again, I am sorry you were disappointed to be removed from the challenge, but I was just trying to enforce a rule that we've always had. Again, it is not an arbitrary rule of the site either; it is US copyright law.

You own the copyright of your own original drawings, BTW, so this is not endless. If you create your own stuff, it is yours. The site posting guidelines also explain this point in some detail.

that´s right and understandable but I have seen these type of cookies in challenge number 1: snowwhite and star wars and they have participated anyway. I have just  seen superman in featured cookies and another character´ cookie that is the most wonderful cookie I have seen in earth and is featured by Cookie Connection.

This is what frustrates me and I feel i was the first cookie erased although perhaps it´s not. Nothing to do for this but couldn´t avoid expressing my self.

You own the copyright of your own original drawings, BTW, so this is not endless. If you create your own stuff, it is yours. The site posting guidelines also explain this point in some detail.

All I can say is that I am human, and I probably have missed some violations of this rule in the past. I will try to be more careful going forward, as I can feel that you are upset.

And, no, you are not the first person to have had a cookie image deleted. There have been many others. (I spend MANY hours each week cleaning up various things on the site, and still miss stuff as you have so noted.) Some people have been asked to remove entire portfolios from the site because they continued to violate this rule after many warnings.

I am sorry, Julia, I am asking just for understanding  correct rules and follow them.

That means I can't post a cookie with a Picasso masterpiece without asking permission to Picasso's intelectual property inheritors? 

It's my opinion, but isn't it too much? I mean, I usually use my own ideas, but the line between inspiration and copy is thin, and so between a copy and a tribute.

I am precisely working on some Picasso's "Guernica" cookies; it's an stunning masterpiece and also a picture full of meaning for Spanish people. And honestly, this kind of cookie is perfect to be shared. For me, cookies are an amazing way to express myself and not just a exhibition of beauty.

Of course I accept Cookie Connection rules. But I also would like to reflect the difficult of setting the limits of this rule and the importance of being respectful and honest like first and more important rule.

If the art is not in the public domain, then you should not be copying without permission, period. Please understand: this is not MY rule or an arbitrary site rule; it is copyright law. This is not me being extreme; I am just trying to inform people of and uphold proper copyright law on this site. Please review the posting guidelines again; they contain a link with several lawyers' commentary on this matter. They also have a link about finding works in the public domain that can safely be copied.

If the clip art is in the public domain, it can be copied, but you have to read and follow the use requirements of the particular clip art that you download; they can vary.

@doctorcookies I think you probably already know how easy it can be to seek permission from (living) artists, and what a gratifying and mutually beneficial process this can be! You and NeGeRa seem to have done exactly this before you posted your Challenge #18 entry this week, which is great!  Many artists are honored to be asked and willingly allow their work to be copied. Plus, there is then the mutual benefit of there now being two parties promoting the work.

However, I've also seen the opposite, where an artist has refused use for various reasons. I do this for some forms of my work (videos, work being used in classes or for other commercial purposes) under some circumstances; in some cases, I also require a licensing fee. In other cases, I allow use for free. But I always hope to be asked first.

I'm sorry I didn't know that. I deleted my character cookie photos, there weren't so many though.  I'm gonna share this on my blog, it might help some Japanese members remind of the rule.

Thank you, especially for sharing on your blog. I have noticed a few other Japanese members posting characters, but I can't always tell if those characters are of their own design or if they are copied, so I haven't pressed the issue in those cases.
